The total number of individuals staying onbrthe Premises during the Lease Term shall be a total of 8brguests.If more than the authorized number of guests listed above are found onbrthe Premises, this Agreement will be subject to termination by the Host. CountybrShort-Term Rental Permit restrictions are strictly enforced. We have no controlbrover the law. Violations of this policy will result in an immediate, no notice,br$500 per additional person per incident penalty fee, charged to the reservationbrcredit card, AND (1) probable notice to vacate the property immediately and (2)brfull loss of remaining rental fees paid and any expenses incurred. brBOOKING FEES. The Guest shall pay the Host the amount asbrdetailed during the booking process. brSECURITY DEPOSIT. The Guest shall be obligated to pay thebrfollowing amounts upon the execution of this Agreement: Security Deposit amountbras detailed in the booking process. The Security Deposit is for the faithfulbrperformance of the Guest under the terms and conditions of this Agreement. ThebrGuest must pay the Security Deposit at the execution of this Agreement. ThebrSecurity Deposit shall be returned to the Guest within the State`s requirementsbrafter the end of the Lease Term less any itemized deductions. This SecuritybrDeposit shall not be credited towards any Rent unless the Host gives theirbrwritten consent. Therebris a beach pass for the summer months that is $200 if lost. brPETS. The Host does not allow pets and has a familybrmember who has severe allergies: There are no pets allowed on the Premises. Ifbrthe Guest is found to have pets on the Premises, this Agreement and anybrSecurity Deposit shall be forfeited. brSMOKING POLICY. NoSmoking on or around property.brSUBLETTING. The guest does not have the right to subletbrthe Premises. brCANCELLATION POLICY AND TRAVEL INSURANCE. Traveling to the Sierra Mountains at any timebrof year has inherent risks and uncertainty such as public health policies,brunexpected or forecasted snow/weather, variable air quality, fires and otherbrnatural disasters, road conditions, traffic, personal health or events,breviction due to guest violation of the rules and policies for the property, andbrother circumstances beyond the property owner`s control. As such, guestsbrare hereby instructed to mitigate their financial responsibility risks bybrpurchasing `cancel for any reason` trip insurance. All of thesebrrisks, except perhaps health, are foreseeable. As such, such a risk or concernbrwould not be considered an `extenuating circumstance` under any bookingbrplatform`s policy. We expect our guests to mitigate these risks by purchasingbrtrip insurance (in particular, `cancel for any reason`brinsurance). Depending on the platform, you may have to pay a 4 percent cancellation fee that the credit card processor does not refund for any cancellations. brINSPECTION. The Host has the right to inspect thebrPremises with prior notice as in accordance with State law. Should the Guestbrviolate any of the terms of this Agreement, the rental period shall bebrterminated immediately in accordance with State law. The Guest waives allbrrights to process if they fail to vacate the premises upon termination of thebrrental period. The Guest shall vacate the Premises at the expiration time andbrdate of this agreement. brMAINTENANCE AND REPAIRS. The Guest shall maintain the Premises in abrgood, clean, and ready-to-rent condition and use the Premises only in a carefulbrand lawful manner. The Guest shall leave the Premises in a ready-to-rentbrcondition at the expiration of this Agreement, defined by the Host as beingbrimmediately habitable by the next Guest. The Guest shall pay for maintenancebrand repairs should the Premises be left in a lesser condition. The Guest agreesbrthat the Host shall deduct costs of said services from any Security Depositbrprior to a refund if the Guest causes damage to the Premises or itsbrfurnishings. brTRASH. The Guests shall dispose of all wastebrmaterial generated during the Lease Term under the strict instruction andbrdirection of Host. We live in bear country and trash is a bit quirky in thebrTahoe area. We apologize and thank you in advance! All trash and recycling mustbrfit in the bear box. If the volume of garbage does not fit, guests must takebrthe excess garbage offsite. Fines for excessive garbage range from $200 tobr$500. Fines for leaving the bear box doors open or garbage anywhere outside ofbrthe bear box start at $1,000 per incident and may exceed $5,000. Such finesbrwill be immediately deducted from the guest`s deposit. brQUIET ENJOYMENT. The Guest, along with neighbors, shall enjoybreach other’s company in a quiet and respectful manner to each other’sbrenjoyment. The Guest is expected to behave in a civilized manner and shall bebrgood neighbors with any residents of the immediate area. Creating a disturbancebrof the area by large gatherings or parties shall be grounds for immediatebrtermination of this Agreement. brHOST’S LIABILITY & MOUNTAIN ENVIRONMENT. The Guest and any of their guests herebybrindemnify and hold harmless the Host against any and all claims of personalbrinjury or property damage or loss arising from the use of the Premisesbrregardless of the nature of the accident, injury, or loss. The Guest expresslybrrecognizes that any insurance for property damage or loss which the Host maybrmaintain on the property does not cover the personal property of the Guest andbrthat the Guest should purchase their own insurance for their guests if suchbrcoverage is desired. This home is located in a mountain environment. Guests arebrrequired to be prepared for all mountain environment conditions, including butbrnot limited to possible exposure to slippery, uneven, unpredictable groundbrconditions; falling pinecones and other nature events; bears, coyotes, bobbrcats, raccoons, squirrels, chipmunks, other rodents and insects and otherbrwildlife; dogs on or off leash; and every other mountain environment condition.brOccupancy of this property is predicated upon every guest indemnifying andbrholding harmless, the property owner for any results of exposure to or contactbrwith mountain environment conditions. Guests are encouraged to carrybrchains when driving in the mountains. brATTORNEY’S FEES. The Guest agrees to pay all reasonable costs,brattorney`s fees, and expenses that shall be made or incurred by the Hostbrenforcing this agreement. brUSE OF PREMISES. The Guest shall use the Premises forbrresidential use only. The Guest is not authorized to sell products or servicesbron the Premises or conduct any commercial activity. brILLEGAL ACTIVITY. Any unreturned cards will result in a $100 replacement fee per card. brbrWhile this house is “pet friendly”, all pets must be disclosed when booking and a non-refundable pet fee must be paid. Maximum 2 mid-size dogs per rental group (any others must be approved by host in advance). Guests agree to take full financial responsibility should there be any damage or additional cleaning required due to pets presence. brbrThere is parking for 3 - 4 cars on the driveway. Note that the detached garage not accessible. brbrNo outdoor fires or charcoal bbq’s allowed per Town of Truckee ordinance. On red flag days, no open flame allowed (i.e. no use of propane grill). brbrTrash must be properly disposed of within metal bear bin alongside driveway. Do not leave any food or beverages in your vehicle as bears will not hesitate to help themselves to your goodies and can cause significant vehicle damage. brbrHome must be properly secured (doors locked, windows closed / locked) whenever not present in the home. brbrThe driveway is on a seasonal plow service, whereas they come once per day when it snows more than 5 inches. They generally follow the road plows and will first clear the berms at the end of the driveway. You’ll need to move your cars so that the plows can access and clear the driveway (which takes less than 5 minutes once cars are out of the way). brbrThere is a path that leads from the driveway to the front entry door. We do our best to ensure reasonable access to the property, but depending on the timing of your arrival (if during or immediately following a storm), there maybe snow on the path. There are shovels located onsite that can be used by guests, but we recommend that you travel with a shovel during winter conditions.brbrWINTER ADVISORY: By reserving this house during the winter months (November - April), you acknowledge that you will be traveling into the mountains and that winter storms are common and often unpredictable. The dates that you are choosing to reserve are being held for your group and are therefore unavailable for other groups to reserve. In all cases, our cancellation policy will prevail. There will be no consideration afforded for difficult travel due to winter weather condition. We strongly advise that you pay attention to incoming storms and / or changes in weather patterns in order to help avoid travel delays or disruptions. It is also strongly advised that you travel with a 4WD or AWD vehicle, carry snow chains , and have a shovel that can be used if needed to dig out a stuck vehicle.brbrALL SEASONS ADVISORY: By reserving this house, you acknowledge that you will be traveling to the mountains and that Lake Tahoe (while beautiful) is in a natural forest setting. As such, it is possible that you may encounter spiders, ants, field mice, etc. at properties throughout the area. We take every proactive measure to prevent pests from finding their way inside the property (i.e. regular cleanings, seasonal deep cleanings, routine pest control - i.e. spray perimeter and crawl space areas, set traps, seal up holes of entry, etc.). Despite those efforts, there’s always a rare possibility that pests can find their way inside the home (as it only takes a very small entry point for that to occur). This is simply a reality of living in the mountains. By accepting our house rules, you acknowledge this Advisory and agree that there will be no refunds or adjustments to pricing should you encounter a pest(s) within the home.
