Drinking games of any kind ie: beer die, pong, funnels etc. and music that is audible past the property line are strictly prohibited. Immediate eviction can result if these rules are broken.brbrSan Diego Municipal Code 59.5.0502 states that at all times; any amplified sound that can be heard 50 feet away from the rented residence is prohibited. Between 10 PM and 8 AM, even normal conversation must be moved inside the rented residence. Per SDMC 51.1004 and California Penal Code 415.2 noise violations can result in fines (Up to $1,000) for property owners and Renters if there are repeated calls for noise violations to one address. Renters will be liable for any and ALL noise violation fines charged to the property owner. Excessive Noise disruptions can result in immediate eviction without the right to a refund of rental fees or security deposits. brbrDrugs/ Alcohol: Use of illegal/illicit drugs by any Renter, Guest, Occupant or Visitor in or on the grounds is strictly prohibited. Consumption of alcoholic beverages by a minor under 21 years of age is strictly prohibited.brbrNo Smoking of ANY kind: This is a non-smoking property, both in and on the property. A fee of $1,000.00 will be charged for violation of this rule, plus any costs incurred to remove smoke odor or damage. Smoking includes but is not limited to: cigarette, cigar, marajuana, cocaine, incense, or vaping. While Marajuana is legal in the state of California it is NOT allowed on this property. brbrProperties are subject to exterior patrol by our staff and homeowner. If Renters are causing a nuisance, having a party, acting detrimentally toward the property, breaking the noise curfew or any stated rules and regulations we reserve the right to terminate the rental agreement, without refund, and immediately remove Renters and guests from the property. Absolutely no disturbances are allowed within this home or anywhere on the property premises. We also reserve the right to refuse occupancy if a house party is suspected. brbrOur neighbors are very, very sensitive to vacation rentals as it affects their right to live in a peaceful environment therefore we will enforce these policies in exchange for the privilege of renting this home as a vacation rental. The City of San Diego has adopted stricter guidelines for vacation properties and bad operators will not be allowed to rent their homes. If the actions of the Renter and their guests are detrimental to our right to rent as a vacation rental we reserve the right to evict and retain any rental fees and/or security deposits and will report abuse to the rental platforms and will take legal action against Renter if their behavior results in loss of permits.brbrGuest Occupancy:brOccupancy: The maximum occupancy for this Rental Agreement shall not exceed the number stated on the reservation. Only primary Renter and guests accounted for on the reservation are allowed to be on the property.brbrAge Restrictions: Primary Renter must be 25 years or older. Guests must be 25 years or older. Parents and children excluded. brbrNo Subletting: If Renter can not keep the reservation please alert us as soon as possible so we can assist in re-renting the unit. If the unit is not re-rented and at the rate of the current reservation Renter will not be refunded their rental fees. brbrIf excessive cleaning is needed, Renter will be charged $100/hour, or actual charges, whichever is greater. With warm antiques and artwork throughout, you feel at home as soon as you walk through the door.brbrJust inside the front door, set away from the bedrooms and living space, you will find the washer and dryer. brbrAs you continue into the condo you will see our first master bedroom. This this room has a large closet, dresser and bedside table with drawers. This room has a 4 poster Queen sized bed that is situated in the corner of the room. The furniture is Transitional style with all black sides and wood finished tops. This room has a unique bathroom in that it is considered both an en suite and guest bathroom. There are 2 doors to this bathroom, one inside the bedroom door and one outside the bedroom door. brbrThe guest bathroom attached to the front master is a large bathroom with large vanity and tub/shower. All of the bathroom hardware has been updated to oil rubbed bronze that compliments the colors of the condo.brbrJust past the first bedroom you will find the open concept kitchen and living room space. The kitchen has a gas stove and oven, stainless steel refrigerator and an over-the-range microwave. As someone who loves to cook, we have also provided plenty of pots and pans, a Cuisinart and many mixing bowls for your needs. We also often have cooking spices and oils, but do not guarantee these items as some people clear out the panty upon departure, while others add. The kitchen also has a bar with 3 stools so that guests, or those not cooking, can keep those in the kitchen company.brbrJust on the other side of the kitchen bar is our living room. Here you will find a small couch, coffee table and smart TV. We welcome everyone to log into their own streaming services, but should you not have any just let us know and we will make sure you have access to Hulu+LIve TV. On the other side of the couch, you will find our sitting space and dining table. There are 2 leather sitting chairs for enjoying the view from the condo or just reading. There is also a folding dining table that accommodates up to 4 people once pulled away from the window. The Guest agrees to occupy the following residence from the Host.brbrLEASE TERM. The Guest shall be allowed to occupy the Premises during their confirmed/booked dates (the “Occupancy Term.”) Check in shall be no earlier than 4:00PM on the first date of the Occupancy Term. Check out shall be no later than 10:00AM on the last date of the Occupancy Term or guests shall incur a late fee of $100 for each half hour they are late to check out. brbrQUIET HOURS. Quiet hours begin at 10:00 PM each night and continue until 8 AM. Quiet hours consist of no music and keeping all audio at a minimum level out of respect for the surrounding residents. If stated in the listing, a Minut noise monitor will monitor the noise levels of the home to ensure appropriate decibel levels are not equal to or exceeding 80 decibels. If noise levels are equal to or exceeding 80 decibels, our team will inform you to quiet down. If the noise disturbance is not dismissed after the first formal warning, Host reserves the right to terminate this Agreement with no refund and immediate removal from the Premises. brbrOCCUPANTS. Unless Guest receives Host`s prior written approval, total number of individuals staying on the Premises during the Lease Term shall be a total of number of guests. If more than the authorized number of guests listed above are found on the Premises or observed on the exterior security cameras entering the home, this Agreement will be subject to termination by the Host with no refund. brbrCREDIT CARD AUTHORIZATION. (If you are an AIRBNB Guest, this section DOES NOT APPLY TO YOU) Guests, excluding Airbnb reservations, agree that a $500 Pre-Authorization will be held on Guest’s provided credit card to be used as a security deposit. By signing this Agreement, Guest authorizes Host to charge the credit card provided as needed to cover any costs incurred under this Agreement. Again, this DOES NOT apply to Airbnb guests. brCredit Card Processing Fees & Cancellations (If you are an AIRBNB Guest, this section DOES NOT APPLY TO YOU): All reservations are subject to a non-refundable credit card processing fee. If a reservation is canceled within the refund-eligible period, the refund will be issued minus the credit card processing fee, which is equal to 5% of the total reservation amount. These fees are non-refundable as they are charged by the payment processor and cannot be recovered. Guest does not have the right to sublet the Premises, in whole or in part, or to otherwise assign, transfer, or convey any rights under this Agreement to any third party. Guest shall not list or advertise the Premises on any platform or service, nor accept any compensation from any third party in connection with occupancy of or access to the Premises. Any unauthorized subletting or transfer of occupancy rights shall constitute a material breach of this Agreement, entitling Host to immediately terminate this Agreement without refund and to pursue any other remedies available at law or in equity. brNO TENANCY; VACATION AND HOLDOVER. Guest expressly acknowledges and agrees that this Agreement creates a limited license to occupy the Premises for the Occupancy Term only, and does not create a tenancy, leasehold interest, or any other possessory right in the Premises under California law or any other applicable law. Guest is a transient occupant and licensee only. No landlord-tenant relationship is created by this Agreement, and Guest shall not be entitled to any of the rights, protections, or procedural requirements afforded to tenants or lessees under California law, including without limitation any notice requirements under the California Civil Code or Code of Civil Procedure. Guest shall vacate the Premises no later than the checkout time on the final date of the Occupancy Term. Time is of the essence with respect to this obligation. Guest waives any and all rights to process, notice, or judicial proceeding as a condition of removal upon expiration or earlier termination of this Agreement, to the fullest extent permitted by applicable law.
