About 30 steps to the sand of Mission Bay and the Boardwalk! The pacific ocean is less than 2 blocks away as well! brbrPROPERTY LAYOUTbrThe first level, just a short staircase up from the front entry, features an open floor plan living room, dining room, and kitchen with bar seating—a great space to share! The outside balcony, accessible from the kitchen and dining area, includes a propane gas grill for convenient dinner grilling. While the unit is not directly on the bay, you can catch a glimpse of the water by peeking out the side balcony. The kitchen is fully stocked for meal prep, dining, and entertaining. The living room is equipped with a smart TV and live TV. On this level, you`ll also find a washer and dryer tucked away in a closet, along with a full guest bathroom and guest bedroom. This bedroom has a new cozy queen size bed, mirrored closet, and smart TV. The main level has central AC and the master level has a window unit. brbrWalk upstairs to the master bedroom suite, featuring a king size bed, private balcony, and bath, plus a twin size floor mattress. Please help us preserve our right to rent by being respectful neighbors.brbrNOISE/NO PARTIES: Quiet hours are strictly enforced, 10 pm – 8 am per city ordinance. This property has ZERO TOLERANCE for noise, parties or loud music which includes any excessive daytime noise, cursing, yelling or screaming. Fines will be applied for complaints. Drinking games of any kind ie: beer die, pong, funnels etc. and music that is audible past the property line are strictly prohibited. Immediate eviction can result if these rules are broken.brbrSan Diego Municipal Code 59.5.0502 states that at all times; any amplified sound that can be heard 50 feet away from the rented residence is prohibited. Between 10 PM and 8 AM, even normal conversation must be moved inside the rented residence. Per SDMC 51.1004 and California Penal Code 415.2 noise violations can result in fines (Up to $1,000) for property owners and Renters if there are repeated calls for noise violations to one address. Renters will be liable for any and ALL noise violation fines charged to the property owner. Excessive Noise disruptions can result in immediate eviction without the right to a refund of rental fees or security deposits. brbrDrugs/ Alcohol: Use of illegal/illicit drugs by any Renter, Guest, Occupant or Visitor in or on the grounds is strictly prohibited. Consumption of alcoholic beverages by a minor under 21 years of age is strictly prohibited.brbrNo Smoking of ANY kind: This is a non-smoking property, both in and on the property. A fee of $1,000.00 will be charged for violation of this rule, plus any costs incurred to remove smoke odor or damage. Smoking includes but is not limited to: cigarette, cigar, marajuana, cocaine, incense, or vaping. While Marajuana is legal in the state of California it is NOT allowed on this property. brbrProperties are subject to exterior patrol by our staff and homeowner. If Renters are causing a nuisance, having a party, acting detrimentally toward the property, breaking the noise curfew or any stated rules and regulations we reserve the right to terminate the rental agreement, without refund, and immediately remove Renters and guests from the property. Absolutely no disturbances are allowed within this home or anywhere on the property premises. We also reserve the right to refuse occupancy if a house party is suspected. brbrOur neighbors are very, very sensitive to vacation rentals as it affects their right to live in a peaceful environment therefore we will enforce these policies in exchange for the privilege of renting this home as a vacation rental. The City of San Diego has adopted stricter guidelines for vacation properties and bad operators will not be allowed to rent their homes. If the actions of the Renter and their guests are detrimental to our right to rent as a vacation rental we reserve the right to evict and retain any rental fees and/or security deposits and will report abuse to the rental platforms and will take legal action against Renter if their behavior results in loss of permits.brbrGuest Occupancy:brOccupancy: The maximum occupancy for this Rental Agreement shall not exceed the number stated on the reservation. Only primary Renter and guests accounted for on the reservation are allowed to be on the property.brbrAge Restrictions: Primary Renter must be 25 years or older. Guests must be 25 years or older. Parents and children excluded. brbrNo Subletting: If Renter can not keep the reservation please alert us as soon as possible so we can assist in re-renting the unit. If the unit is not re-rented and at the rate of the current reservation Renter will not be refunded their rental fees. brbrIf excessive cleaning is needed, Renter will be charged $100/hour, or actual charges, whichever is greater. If area carpets are excessively dirty after check out Renter will be charged a $300 fee for carpet cleaning or full replacement value PLUS any loss in rental income at $500/night.brbrNO DAILY MAID SERVICE: Daily maid service is not included in the rental rate. The cleaning fee referenced above shall be applied to the cleaning service after check out. No landlord-tenant relationship is created by this Agreement, and Guest shall not be entitled to any of the rights, protections, or procedural requirements afforded to tenants or lessees under California law, including without limitation any notice requirements under the California Civil Code or Code of Civil Procedure. Guest shall vacate the Premises no later than the checkout time on the final date of the Occupancy Term. Time is of the essence with respect to this obligation.
